1. Scope
These Terms and Conditions apply to all contracts between supplement-check.eu (hereinafter "Provider") and business customers (hereinafter "Customer") for the use of the compliance check platform.
B2B Only: The service is exclusively directed at businesses. Consumer use is excluded.
2. Service Description
2.1 Scope
The Provider offers a web-based software platform with the following features:
- Compliance checks for food supplements in the EU
- Analysis of health claims and maximum levels
- Export of reports as PDF/Excel
- Report history according to subscription tier
2.2 Availability
The Provider strives for high platform availability. However, 100% availability cannot be guaranteed. Maintenance work may temporarily restrict availability.
3. Contract Formation and Registration
3.1 Registration
The Customer registers on the platform with email address and password. Upon registration, the Customer receives access to the Free tier (3 checks).
3.2 Contract Formation
A contract for a paid subscription is formed by selecting a plan and completing the checkout process. The Customer receives a confirmation email.
4. Prices and Payment Terms
4.1 Prices
The prices listed on the pricing page apply:
- Free: €0 (3 checks, 5 countries)
- Starter: €49/month (10 checks, 10 countries)
- Professional: €149/month (25 checks, 28 countries)
- Enterprise: €499/month (100 checks, 28 countries)
- Agency: €999/month (unlimited checks, 28 countries)
All prices are net prices. No VAT is charged according to § 19 UStG (small business regulation).
4.2 Payment Methods
Payment is due monthly in advance via:
- Credit card (Visa, Mastercard, American Express)
- SEPA direct debit
- PayPal
Payment processing is handled by Stripe.
4.3 Payment Default
In case of payment default, the Provider may temporarily suspend platform access until payment is received.
5. Term and Termination
5.1 Term
The contract runs for an indefinite period. Monthly billing occurs at the beginning of each billing period.
5.2 Notice Period
The contract may be terminated by either party at any time at the end of the month. Cancellation is done via the Stripe customer portal or by email to [email protected].
5.3 Extraordinary Termination
The right to extraordinary termination for good cause remains unaffected. Good cause exists in particular in case of violation of these Terms or payment default.
6. Refund Policy
No Refunds: After using the services (performing compliance checks), no refund of already paid amounts will be provided. The service is considered rendered upon provision of access and use of checks.
7. Customer Obligations
7.1 Terms of Use
The Customer agrees to:
- Use the platform only for lawful purposes
- Keep access credentials confidential
- Not use automated systems (bots) for platform use
- Not engage in abusive use
7.2 Own Responsibility
The Customer is solely responsible for verifying the accuracy and completeness of results generated by the platform. The platform does not replace legal advice.
8. Liability
8.1 Limitation of Liability
The Provider is only liable for intent and gross negligence. Liability for slight negligence is excluded, unless essential contractual obligations are violated.
8.2 No Warranty for Accuracy
The Provider assumes no warranty for the completeness, accuracy, and timeliness of the provided regulatory data. Compliance checks are for informational purposes only and do not constitute legal advice.
Important Notice:
The results of compliance checks are not legally binding. For binding information, please consult a specialist lawyer for food law.
8.3 Damages
In case of violation of essential contractual obligations, liability is limited to the contractually typical, foreseeable damage.
9. Intellectual Property
All platform content (software, databases, texts, graphics) is protected by copyright. The Customer receives a simple, non-transferable right of use for the duration of the contract.
Transfer, reproduction, or commercial use of content is prohibited without written permission.
10. Privacy
The Provider processes personal data in accordance with the General Data Protection Regulation (GDPR). Details can be found in our Privacy Policy.
11. Amendment of Terms
The Provider reserves the right to amend these Terms at any time. Customers will be informed of significant changes by email. If the Customer does not object within 30 days, the new Terms are considered accepted.
12. Final Provisions
12.1 Jurisdiction
The place of jurisdiction for all disputes arising from this contract is Bad Kreuznach, Germany, insofar as the Customer is a merchant, legal entity under public law, or special fund under public law.
12.2 Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
12.3 Severability
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
